Welcome to Phenyx. By downloading, accessing, or using the Phenyx mobile application, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using Phenyx, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the app.

2. Description of Service

Phenyx is an AI-powered reading companion that helps you track books, capture reflections, build a personal knowledge graph, engage with Socratic questioning, participate in reading communities, and retain ideas through spaced repetition. Features may be updated, modified, or discontinued at our discretion.

3. User Accounts

You are responsible for maintaining the security of your account and password. You are responsible for all activity that occurs under your account. You must provide accurate and complete information when creating your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Billing

Phenyx offers the following subscription plans:

Free Discovery: All new users can explore Phenyx with a free 30-minute discovery session with no subscription required.

Free Trial: New subscribers receive a 1-year free trial with full access to all features.

Phenyx Monthly: $7.99 per month, billed monthly.

Phenyx Annual: $74.99 per year, billed annually (save 22%).

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.

5. User Content

You retain ownership of all content you create in Phenyx, including reading notes, reflections, and posts. By posting content to Circle or book clubs, you grant Phenyx a non-exclusive, worldwide license to display that content to other users as part of the social features. You may delete your content at any time. You agree not to post content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.

6. AI-Powered Features

Phenyx uses artificial intelligence to provide Socratic questioning, knowledge graph connections, and reading insights. AI-generated content is provided for educational and reflective purposes and should not be considered professional advice. AI responses may occasionally be inaccurate or incomplete.

7. Community Guidelines

When using Circle and book clubs, you agree to treat other users with respect, not post spam, promotional content, or misleading information, not harass, bully, or intimidate other users, and not impersonate other users or entities. We reserve the right to remove content or suspend accounts that violate these guidelines.

8. Intellectual Property

Phenyx, including its design, features, branding, and underlying technology, is owned by Phenyx and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the application.

9. Limitation of Liability

Phenyx is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability shall not exceed the amount you paid for the service in the preceding 12 months.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through your profile settings or by contacting us. Upon termination, your right to use the app ceases immediately. We may delete your data in accordance with our Privacy Policy.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the app or via email. Continued use of Phenyx after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles.
